2009 LEGISLATIVE SESSION UPDATE
The 2009 General Legislative began on January 26, and will run through March 12, 2009. 
 
Utah Clean Energy supports the development of public policies that speed the adoption of energy efficiency and renewable energy technologies in Utah.  Below is a listing of clean energy legislation under discussion for the 2009 session.

Summary of Known Energy Efficiency and Renewable Energy Legislation Under Discussion for the 2009 Utah Legislative Session 
 
Mechanical Contractor Licensing Provisions: HB 117 – Representative Wiley
This legislation makes changes to Utah’s current Mechanical Contractor Licensing Provisions to improve public health and safety, save Utahns energy, and improve HVAC contractor training by requiring technicians to be licensed by the Division of Professional Licensing. This policy would require all HVAC mechanical technicians to receive training and licensing consistent with other trades to improve HVAC installation practices, ensure proper sizing, improve health and safety, and increase the energy efficiency of installed HVAC systems.
 
Model Renewable Energy Ordinance Resolution: SJR 1 – Senator Jones
Local ordinances play a significant role in the development and implementation of renewable energy projects of all sizes. This resolution provides a state?endorsed model ordinance for wind and encourages local governments to adopt the ordinance. This resolution also directs the state to develop model solar and geothermal ordinances in the near future through public stakeholder processes. This resolution will reduce bureaucracy and cost to cities, counties, and taxpayers by providing model ordinance language that will serve as a tool and resource for local governments, while also helping remove barriers to the adoption of distributed and utility?scale renewable energy projects across the state.
 
Joint Resolution on Cost?effective Energy Efficiency and Utility Demand?Side Management: HJR 09 (Rep. Barrus)
This resolution recognizes the multifaceted benefits of utility energy efficiency and sets energy savings goals of at least 1 percent per year for Utah’s electric corporations and at least 0.5 percent per year for Utah’s natural gas utility corporations. This resolution also encourages the Utah Public Service Commission, which regulates many utility companies in the state of Utah, to remove financial disincentives to utility efficiency programs.
 
Rocky Mountain Power Energy and Regulatory Bill
This bill includes a number of provisions to facilitate cost recovery for Rocky Mountain Power, including: a fuel and power cost adjustment mechanism; changes to rate case provisions; interim rate provisions that allow for an increase or decrease in rates between rate cases; authority to charge interest to ratepayers on construction work in progress; timely recovery of investments for major plant additions; authorization of specific low income programs; infrastructure development fees for new customers, with provisions to offset fees through energy efficiency or renewable energy; and authority for revenue decoupling and incentive programs that would remove utility disincentives and encourage expansion of utility energy efficiency programs.
 
Renewable Energy Certificate Revisions: SB99 (Sen. Bramble)
This bill directs the commission to establish a process for issuance or recognition of renewable energy certificates.
